Abstract

Law in context disability sport true inclusion discriminiation reasonable adjustments
The law plays a crucial role in the treatment of children with disability in competitive sport. It can lead to improved experiences for those children. If not implemented in the right way, it can hinder and hamper experiences of children with disability in sport. This thesis considers the way the law applies to the structures, rules and policies in competitive sport in Australia, and argues that using discrimination law to identify treatment as discriminatory can lead to the law, or more importantly its implementation, providing a solution to the exclusion of children with disability from meaningful experiences in competitive sport. The solution proposed in this thesis is the introduction of Guidelines for the inclusion of children with disability in competitive sport, as provided for in the Disability Discrimination Act 1992 (Cth) (‘DDA’). This thesis culminates, in Chapter 7, with draft Guidelines.
